TUITION CENTRAL TERMS AND CONDITIONS

These Terms govern all use of Tuition Central's services, including all bookings, tutoring sessions, and communications conducted via TutorCruncher or any associated systems (“Platform”).

By registering, booking a session, or using our services, you agree to these Terms.

 

1. Definitions

  • “Tuition Central” / “we” / “us”: Tuition Central, the company providing services.
  • “Client”: A student, parent, or guardian registered to use the Platform.
  • “Tutor”: An independent contractor providing tutoring services through Tuition Central.
  • “Platform”: TutorCruncher and any integrated systems used for booking, communication, invoicing, and delivery.
  • “Session”: Any tutoring lesson delivered online.
  • “Services”: All tutoring and related services provided via Tuition Central.
  • “Unauthorized Tutoring”: Any arrangement between a Tutor and Client outside the Platform without written approval from Tuition Central.

 

2. Platform Model and TutorCruncher Use

  • All bookings, scheduling, messaging, and payments are managed through TutorCruncher.
  • TutorCruncher is a third-party software provider and is not a party to the tutoring contract.
  • Tuition Central is the contracting party responsible for providing tutoring services.
  • Platform records (messages, bookings, invoices, attendance) stored in TutorCruncher form part of service administration.

 

3. Contractual Relationship

  • Tuition Central acts as a tutoring agency and service provider.
  • Tutors are independent contractors and not employees of Tuition Central.
  • Clients contract with Tuition Central for the provision of tutoring services.

 

4. Access and Service Delivery

  • Access to services is granted upon registration and acceptance of these Terms.
  • We do not guarantee the availability of any specific Tutor at all times.

 

5. Booking, Payments and Cancellation

5.1 Booking

  • All Sessions must be booked through the Platform.
  • A booking is confirmed once scheduled and accepted in TutorCruncher.

 

5.2 Payments

  • All payments are processed via TutorCruncher.
  • Fees must be paid in accordance with invoices issued.

 

5.3 Cancellation Policy

  • Cancellations made less than 24 hours before a Session will be reviewed on a case-by-case basis. Depending on the circumstances and reason for cancellation, the full Session fee may still be charged.
  • Late cancellations and no-shows are non-refundable unless otherwise agreed.

 

5.4 Refunds

  • Refunds are only issued where Tuition Central is unable to deliver the Service due to fault on our side.
  • Where a refund is approved, the amount will be credited to the Client's TutorCruncher account for use against future bookings and services. Direct refunds to a bank account or original payment method will only be provided where required by law or in exceptional circumstances determined by Tuition Central.
  • Platform or technical issues will be reviewed on a case-by-case basis.

 

6. No Circumvention / Off-Platform Activity

  • Clients and Tutors must not exchange contact details for the purpose of bypassing Tuition Central.
  • All communication, booking, and payment must remain within the Platform.
  • Breaches may result in:
    • account suspension or termination
    • loss of access to Tutors
    • recovery of losses where legally enforceable

 

7. Tutoring Sessions

  • Sessions will take place online.
  • Tuition Central does not guarantee academic outcomes or exam results.
  • Tutors must conduct sessions professionally and in accordance with safeguarding expectations.

 

8. Group Lessons

  • Group lesson places are charged per student per seat.
  • A Client may withdraw from a group programme by providing at least 14 days' written notice. Any lessons scheduled during the notice period remain chargeable.
  • When a Client books a place in a group lesson programme consisting of multiple scheduled lessons, the Client is reserving a place for the duration of the programme. Tuition Central allocates resources, tutor availability, and group capacity based on these bookings. Lessons will proceed irrespective of the attendance of any individual student. Non-attendance does not affect the fees payable, and no refund, credit, or fee reduction will be provided for missed lessons unless otherwise agreed by Tuition Central in its sole discretion.
  • All fees relate to the reservation of a place within the programme, not individual attendance at sessions.

 

9. Recording and Monitoring

9.1 Purpose of Recording

  • Selected sessions may be recorded for the following purposes:
  • Safeguarding and student safety
  • Quality assurance and service improvement
  • Tutor training and development
  • Dispute resolution or complaint investigation

 

9.2 Frequency of Recording

Recording is not a standard feature of all lessons. Only selected sessions will be recorded where it is considered necessary for the purposes outlined above.

 

9.3 Use and Handling of Recordings

  • All recordings are treated as confidential.
  • Recordings are stored securely and accessed only by authorised personnel.
  • Recordings are not shared publicly or with third parties unless required by law.

 

9.4 Consent and Notice

  • Where required by law or internal safeguarding policy, appropriate notice and/or consent will be obtained before a recording takes place.

 

9.5 Data Protection

  • All recordings are processed in accordance with UK GDPR and Tuition Central's Privacy Policy.

 

10. Tutor Conduct and Safeguarding

  • Tutors must present themselves and their teaching environment in a professional manner appropriate for online learning.
  • Tutors operate under safeguarding requirements appropriate for working with minors.
  • Tutors must keep video enabled during sessions unless an exemption is granted during onboarding.

 

11. Client Responsibilities

Clients agree to:

  • ensure timely attendance for sessions
  • provide accurate registration information
  • maintain respectful communication
  • ensure a safe environment for online learning

 

12. Data Protection and Privacy

  • Tuition Central is the data controller under UK GDPR.
  • Personal data is processed only for:
    • delivering tutoring services
    • managing bookings and payments via TutorCruncher
    • safeguarding and compliance
  • Data is not sold or shared except where legally required.

 

13. Liability

  • Tuition Central does not guarantee academic results or performance outcomes.
  • We are not liable for indirect, incidental, or consequential losses.
  • Liability is limited to the value of services paid, where permitted by law.

 

14. Suspension and Termination

  • Tuition Central may suspend or terminate accounts for breach of these Terms.
  • Clients may stop using services at any time but remain liable for unpaid sessions.

 

15. Changes to Terms

  • These Terms may be updated from time to time.
  • Continued use of the Platform constitutes acceptance of updated Terms.

 

16. Governing Law

  • These Terms are governed by the laws of England and Wales.
  • Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
